Using great literature to teach ethics to machines is a dangerous game. The classics are a moral minefield.

When he wrote the stories in I, Robot in the 1940s, Isaac Asimov imagined a world in which robots do all humanity’s tedious or unpleasant jobs for them, but where their powers have to be restrained. They are programmed to obey three laws. A robot may not injure another human being, even through inaction; a robot must obey a human being (except to contradict the previous law); a robot must protect itself (unless this contradicts either of the previous laws).

To explain why the system developed in his Distributed Computing Lab (DCL) represents a paradigm shift in how we think about cryptocurrencies—and about digital trust in general—Professor Rachid Guerraoui uses a legal metaphor: all players in this new system are “innocent until proven guilty.”

This is in contrast to the traditional Bitcoin model first described in 2008 by Satoshi Nakamoto, which relies on solving a difficult problem called “consensus” to guarantee the security of transactions. In this model, everyone in a distributed system must agree on the validity of all transactions to prevent malicious players from cheating—for example, by spending the same digital tokens twice (double-spending). In order to prove their honesty and achieve consensus, players must execute complex—and energy-intensive—computing tasks that are then verified by the other players.

Debates about rights are frequently framed around the concept of legal personhood. Personhood is granted not just to human beings but also to some non-human entities, such as corporations or governments. Legal entities, aka legal persons, are granted certain privileges and responsibilities by the jurisdictions in which they are recognized, and many such rights are not available to non-person agents. Attempting to secure legal personhood is often seen as a potential pathway to get certain rights and protections for animals1, fetuses2, trees and rivers 3, and artificially intelligent (AI) agents4.

It is commonly believed that a new law or judicial ruling is necessary to grant personhood to a new type of entity. But recent legal literature 5–8 suggests that loopholes in the current law may permit legal personhood to be granted to AI/software without the need to change the law or persuade a court.

For example, L. M. LoPucki6 points out, citing Shawn Bayern’s work on conferring legal personhood on AI7, 8, “Professor Shawn Bayern demonstrated that anyone can confer legal personhood on an autonomous computer algorithm merely by putting it in control of a limited liability company (LLC). The algorithm can exercise the rights of the entity, making them effectively rights of the algorithm. The rights of such an algorithmic entity (AE) would include the rights to privacy, to own property, to enter into contracts, to be represented by counsel, to be free from unreasonable search and seizure, to equal protection of the laws, to speak freely, and perhaps even to spend money on political campaigns. Once an algorithm had such rights, Bayern observed, it would also have the power to confer equivalent rights on other algorithms by forming additional entities and putting those algorithms in control of them.”6. Judge rules against Johnson & Johnson in landmark opioid case in Oklahoma

Oklahoma Attorney General Mike Hunter had claimed that J&J and its pharmaceutical subsidiary Janssen aggressively marketed to doctors and downplayed the risks of opioids as early as the 1990s. The state said J&J’s sales practices created an oversupply of the addictive painkillers and “a public nuisance” that upended lives and would cost the state $12.7 billion to $17.5 billion. The state was seeking more than $17 billion from the company.

J&J, which marketed the opioid painkillers Duragesic and Nucynta, has denied any wrongdoing. Lawyers for the company disputed the legal basis Oklahoma used to sue J&J, relying on a “public nuisance” claim. They said the state has previously limited the act to disputes involving property or public spaces.

Investors were expecting J&J to be fined between $500 million and $5 billion, according to Evercore ISI analyst Elizabeth Anderson.

In the 2015 movie “Chappie”, which is set in the near future, automated robots comprise a mechanised police force. An encounter between two rival criminal gangs severely damages the law enforcing robot (Agent 22). His creator Deon recommends dismantling and recycling the damaged police droids. However, criminals kidnap Deon and force him to upload human consciousness into the damaged robot to train it to rob banks. Chappie becomes the first robot with the human mind who can think and feel like a human. Later, in the movie when his creator Deon is dying, it’s Chappie’s turn to upload Deon’s consciousness into a spare robot through a neural helmet. Similarly, in the “Avatar” a 2009 Hollywood science fiction, a character in the film by name Grace connects with Eiwa, the collective consciousness of the planet and transfers her mind to her Avatar body, while another character Jake transfers his mind to his Avatar body rendering his human body lifeless.

Mind uploading is a process by which we relocate the mind, an assemblage of memories, personality, and attributes of a specific individual, from its original biological brain to an artificial computational substrate. Mind uploading is a central conceptual feature of many science fiction novels and films. For instance, Hanson’s book titled “The Age of Em: Work, Love and Life when Robots Rule the Earth” is a 2016 nonfiction book which explores the implications of a future world when researchers have learned to copy humans onto computers, creating “ems,” or emulated people, who quickly come to outnumber the real ones.
